คุณย่าเข้าโรงพยาบาลจึงจำเป็นต้องใช้เงินจำนวนมากในการรักษาพยาบาล แต่เงินและบัญชีของย่าถูกอาเก็บเอาไว้ และไม่ให้เอามาใช้ในการรักษา เมื่อถามหาก็อ้างว่าไม่มี จะต้องทำอย่างไรดีคะ ในกรณีถ้าอามีชื่อร่วมอยู่ในบัญชีในการถอนเงิน จะต้องทำอย่างไร | |

ถ้าอามีชื่อถือบัญชีร่วมกับย่า อาต้องลงลายใมือชื่อถอนเงินด้วย จึงจะนำเงินออกมาได้ กรณีนี้ยังไมุ่่ถือเป็นมรดก เพราะย่ายังไม่เสียชีวิต ก็ใช้วิธีแจ้งให้อาถอนเงินมารักษาย่า ถ้าเขาไม่ยินยอม ก็ต้องใช้วิธีให้ย่ามอบอำนาจให้ลูกคนใดคนหนึ่ง ร้องศาลขอแบ่งเงินในบัญชี กรณีนี้ถือว่า อามีส่วนเป็นเจ้าของครึ่งหนึ่ง ถ้ามีเงินในบัญชี 10 ล้านบาท ก็ร้องขอส่วนแบ่งของย่า 5 ล้านบาทได้.....ควรหาญาติผู้ใหญ่ที่เป็นที่เคารพของ อา ให้เขายินยอมถอนเงินมารักษา แม่ของตน ก่อนจะมีการฟ้องร้องครับ | |

ถ้าที่ดินถูกโอนเป็นชื่ออาไปแล้วย่อมหมายความว่ากรรมสิทธิ์ตกเป็นของอาไปแล้วครับ ฉนั้นมันจึงไม่ใช่ทรัพย์มรดกของย่าที่จะนำไปแบ่งกันได้อีกต่อไป ส่วนเงินนั้นหากเป็นชื่อร่วมกันกับย่าส่วนของย่าก็จะตกทอดไปสู่กองมรดกครับ | |
