การใช้นามสกุล
เรียนถามนะคะ การแจ้งเกิด ๑. กรณีการแจ้งเกิดถ้าบดามารดาจดทะเบียนสมรสบุตรที่เกิดมาต้องใช้นามสกุลของบิดาโดยอัตโนมัติ ถึงแม้ว่าไม่ใช่บิดาไปแจ้งเกิดก็สามารใช้นามสกุลของบิดาได้ แต่กรณีข้อที่ ๒ ๒. กรณีบิดามารดาไม่ได้จดทะเบียนสมรส ถ้าบิดาไม่ได้ไปแจ้งเกิดให้ใช้นามสกุลมารดา เช่นมารดาไปแจ้งเกิดเองหรือให้ญาติไปแจ้งเกิดแทนก็จะไม่สามารถใช้นามสกุลบิดาได้ (เคยไปแจ้งเกิดให้หลานนายทะเบียนเขาบอกมาอย่างนี้) อยากทราบว่ากฏหมายตัวนี้อยู่ในมาตราไหนคะ หมวด 2 ว่าด้วยสิธิบิดามารดาและบุตร ตามมตรา 1561 บุตรมีสิทธิใช้ชื่อสกุลของบิดากรณีไม่ปรากฏบิดาให้ใช้นามสกุลมารดา แต่ทำไมเวลาไปแจ้งเกิดเขาถึงไม่ใช้นามสกุลบิดา(กรณีไม่ได้จดทะเบียนสมรถและบิดาไม่ได้ไปแจ้งเกิดโดยให้ญาติไปแจ้งเกิดแทน)

ถ้าไม่จดทะเบียนสมรส ถ้าจะใช้ชื่อสกุลของบิดา บิดาต้องให้ความยินยอมก่อน.....
