เรียน...ปรึกษาเรื่องที่ดินค่ะ
รบกวนขอคำปรึกษาค่ะ (ปรึกษาแทนคุณพ่อ) คือ มีปัญหาเกี่ยวการปลูกบ้านในที่ดินที่มีรายชื่อร่วมกันในโฉนดแล้วตกลงกันไม่ได้ค่ะ ความเป็นมาคือ มีที่ดินอยู่ผืนหนึ่ง เนื้อที่ประมาณ 10 ไร่ เป็นที่ดินตกทอดเป็นรุ่น ๆ โดยที่ไม่มีการแบ่งส่วน เช่น เป็นที่ดินของปู่ เมื่อปู่ตายก็ตกเป็นของย่า พอย่าตายก็เป็นของรุ่นลูก ลูกมีทั้งหมด 5 คน เสียชีวิตไป 3 คน เหลือ 2 คน คือ คุณป้า กับ คุณพ่อ เมื่อพี่น้องของพ่อ ตาย 3 คน ทายาทของผุ้ตายก็ลงรายชื่อในโฉนดขอรับส่วนของผุ้ตายแทน 10 ปีกว่าก็ไม่มีการทำอะไรกับที่ดินผืนนี้ ไม่มีการติดต่อจากญาติที่มีรายชื่อในโฉนด มาเมื่อปีที่แล้ว ทางราชการได้มีหมายเวนคืนที่ดินไปสร้างทางด่วน จากเนื้อที่ 10 ไร่ โดนทางด่วนไป 8 ไร่ เหลืออยู่ 2 ไร่กว่า พ่อจึงแจ้งให้ญาติทราบ ในที่ดินผืนนี้ไม่มีสิ่งปลูกสร้างอื่นใด นอกจาก บ้านของปู่ที่คุณพ่ออยู่มาตั้งแต่เกิดและจนถึงปัจจุบัน รวมอายุพ่อตอนนี้ 53 ปี พื้นที่นี้เป็นสวน พอโดนทางการสั่งรื้อบ้าน ครอบครัวก็มีความเดือดร้อนเรื่องที่อาศัย และจะปลูกบ้านหลังใหม่ขึ้นมาในพื้นที่ ๆ เหลือ มีการคุยกันกับ ญาติ ๆ ทั้ง 5 กลุ่ม (มาจากพี่น้องของพ่อ รวมกัน 5 คน ตาย 3 คน และผู้ตายมีทายาท เอารายชื่อมาลงแทนผู้ตาย) ว่าจะขอรายชื่อเพื่อยินยอมให้ปลูกบ้าน แต่เกิดปัญหา ว่า กลุ่มญาติ ยินยอม 3 กลุ่ม ส่วนอีก 2 กลุ่มคัดค้าน พวกเค้าให้จับฉลากเลือกที่ การที่จะปลูกบ้านเราไม่มีเจตนาไปแย่งที่ดินส่วนที่เหลือทั้งผืน แต่ต้องการระบุจุดที่ตั้งของบ้าน ด้วยสาเหตุที่ว่า เราอยู่มานานแล้ว การต่อท่อน้ำประปา หรือไฟฟ้า เราดำเนินการ แล้วต้องการปลูกที่อยู่ใกล้จุดน้ำไฟที่ทางการได้ย้ายเสาไฟมาให้ เรามีบ้านเลขที่ พ่อเป็นเจ้าบ้าน ถ้าจับฉลากแล้วได้ที่ไกลกว่ากว่านี้ ความยุ่งยากเกิดขึ้นมากมาย เพราะปลายสวนหรือส่วนอื่นน้ำไฟยังเข้าไม่ถึง แล้วที่สำคัญ คือ พื้นที่ติดต่อยังเป็นสวนของคนอื่นซึ่งเป็นที่รกๆ เหมือนกัน ส่วนญาติคนอื่นมีการตั้งถิ่นฐานอยู่ที่อื่น ไม่มีความเดือดร้อนเรื่องที่อยู่อาศัย การแบ่งส่วนตกลงกันว่า จะรางวัดและแบ่งออกมาเท่า ๆ กัน คุณพ่อก็ตกลง แต่ขอเลือกที่ตั้งปลูกบ้าน ในทำเลที่เราดำเนินชีวิตประจำวันได้สะดวกเหมือนตอนที่บ้านเก่ายังไม่รื้อ ส่วนพวกญาติถ้าแบ่งออกไปแล้วเค้าคงนำไปขาย ไม่มีใครคิดที่จะมาสร้างที่อยุ่อาศัย เพราะเค้าดำรงชีวิตอยู่ที่อื่นแล้ว เช่น กลุ่มหนึ่งอยู่ อยุธยา กลุ่มหนึ่งอยู่ชลบุรี กลุ่มหนึ่งอยู่กรุงเทพฯ ในฐานะที่พ่ออยู่ในที่ดินผืนนี้มาตั้งแต่เกิด ด้วยความคุ้นเคย คนแถวนั้นรู้จักกันทั้งตำบล เรียกว่าเป็นคนในพื้นที่แต่กำเนิด เมื่อทางการเวนคืน โดนที่ดินและบ้าน ก็อยากจะอยู่ในบริเวณที่เหลือ เพราะพ่อก็อยากรักษาที่ดินที่ถือว่าเป็นของปู่ไว้ ไม่อยากให้ขายตกเป็นของคนอื่น อยากรักษาส่วนที่เหลือที่แบ่งออกมาแล้วอย่างเท่า ๆ กัน ไว้อยู่อาศัย แต่ขอเพียงเลือกจุดที่จะปลูกบ้านเท่านั้น ไม่คิดจะครอบครองที่ดินทั้งผืนเลย แต่มีปัญหาตกลงกันไม่ได้ ถ้าเกิดมีการฟ้องร้อง 1. เราสามารถเรียกร้องสิทธิ์ในการเลือกที่ปลูกบ้านได้หรือไม่??? ถ้า 3 คนใน 5 ยินยอม ให้ปลูก เพราะเค้าคิดว่า เค้าไม่อยู่ที่นี่อยู่แล้ว แต่คนที่อยู่คือ พ่อ ที่อยู่มานานแล้ว เค้ายินยอมเซ็นต์ให้ปลูกบ้านได้ 2. จะมีกฏหมายข้อไหนที่ให้สิทธิ์กับผุ้ที่อยู่อาศัยมานาน ที่ว่าด้วยการครอบครองที่ดิน และเลี้ยงบิดา มารดาจนถึงแก่กรรม 3. จากเรื่องที่เล่ามาอาจจะไม่ละเอียดพอ แต่จะเรียนถามว่า ถ้าเกิดเป็นคดีความกันเกิดขึ้น ทางเรามีโอกาสสู้คดี เพือ เลือกที่ปลูกบ้าน และขอแบ่งที่ดินที่ปลูกบ้านนี้มาเป็นที่ดินของเรา จากโฉนดรวมได้หรือเปล่า???คะ พ่อเป็นลูกของปู่ แต่ คนที่ไม่ยินยอม เป็นหลาน คือ ทายาทของผุ้ตาย ซึ่งมีศักดิ์เป็น พี่ของพ่อ ในการสืบสายเลือดจากปู่โดยตรงถือว่ามีสิทธิ์มากกว่า หลาน ไม๊คะ รบกวนขอคำแนะนำด้วยนะคะ จะเป็นพระคุณอย่างยิ่ง

ถ้าเราเช่าโรงงานแล้วเราต่อเติมโรงงานแต่ตอนนี้มันโดนทางด่วนสัสัญญาค่าเช่าก็ขาดมาหลายปีแล้วถ้ถ้าเราจะย้ายออกเราจะมีสิทธิ์ที่จะหรือถอนสิ่งที่เราต่อเติมได้หรือใหม่หรือว่าจะมีสิทธิ์เรียกร้องค่าต่อเติมได้หรือไม่อย่างไรครับ

คือที่นาของแม่มีชื่อน้องๆ 4คนและแม่ แม่เป็นพี่สาวคนโต แต่ตอนนี้ แม่ได้เสียชีวิตลง ยังไม่ได้แบ่ง

และน้องของแม่ก็เสียชีวิตลง 2 คน มันยากมากที่จะแบ่งต้องเรียกลูกๆ มาเซ็นโอนกันแต่ปัญหา

คือ ว่างไม่พร้อมกันซักที มีทางไหนบ้างคะที่จะโอนกันโดยไม่ต้องให้ลูกๆ มาเซ็น พอจะมีทางเป็น
